How do Immigration Rebalance Impacts Migrant Workers?

Certain changes have been designed after July 2022 by the New Zealand Government for migrant workers. They are meant to attract highly skilled applicants in the health and disability sectors. Support will be there to provide care for the workforce sector to shift itself from relying on unskilled workers.

Both, the health and disability sectors like others will be able to recruit migrants having open work rights. The changes apply to workers that depend on employer-assisted work visas. As the Accredited Employer Work Visa will be considered to be the main pathway for a temporary work visa, it will replace essential skills visas and many other immigration visas.

What are the Changes that Employers Need to Implement?

The employers need to have accreditation of AEWV (Accredited Employer Work Visa) to become eligible to hire a migrant worker. They must have achieved the accreditation by 2023 otherwise, it may cause some problems. Changes are not required to employment agreements with migrant employees.

Also, the median wage threshold will not be applicable at the time of hiring working students or holidaymakers. Unless the occupation has been exempted as per the sector agreement, the minimum threshold wage will be $27.76 on an hourly basis.

No change has been implemented for the following as of now:

  • Partners of New Zealanders 
  • Short-term visitor visa 
  • Working holiday schemes 
  • Recognized seasonal employer scheme 
  • Family categories 

What are the Additional Changes that Have been Introduced?

The newly introduced framework of immigration rebalance is inclusive of some more checks for an employer, apart from accreditation. If these checks are not met by an employer, then it hiring a migrant worker may be difficult. Those checks include:

  • Having a check on the job – Check will be carried out in a detailed manner for confirming the terms and conditions of the employment. They must comply with the laws of employment and test related to the labor market. 
  • Check on migrant workers – Also, the migrant workers have to meet the requirements related to health, character, and identity. They must be in a position to provide proof regarding the skills and experience as needed by the employer.
